When you choose cloud sync or AI analysis, you authorize us and necessary providers to transmit, store, and process the relevant content only as needed to deliver that feature. AI-generated drum charts are drafts that you should review.
本服务条款（“条款”）是你与成都图样图森科技有限公司（“我们”）之间就使用手指鼓 FingerDrum（“本 App”）达成的协议。安装或使用本 App 即表示你同意受本条款及隐私协议约束；若不同意，请勿使用。These Terms of Service ("Terms") form an agreement between you and Chengdu Tuyang Tusen Technology Co., Ltd. ("we", "us") regarding FingerDrum (the "App"). By installing or using the App, you agree to these Terms and the Privacy Policy; if you do not agree, do not use the App.
在你遵守本条款的前提下,我们授予你一项个人的、非独占、不可转让、可撤销的许可,允许你在你拥有或控制的设备上,出于个人或内部使用目的安装与使用本 App。Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for personal or internal use.
你不得:对本 App 进行反向工程、反编译或试图获取源代码;出租、出售、再许可或分发本 App;移除任何权利声明或标识。You may not: reverse engineer, decompile or attempt to derive the source code of the App; rent, sell, sublicense or distribute the App; or remove any proprietary notices or marks.
部分本地功能无需账号；AI 分析、账号绑定权益及某些云功能需要登录。你应提供准确资料、保护登录凭证，并对账号下的活动负责。App 可提供无需付费的功能，也可通过 Apple App Store 或 Google Play 提供内购；实际可用性、价格、付款、计费与退款以相应商店页面和政策为准。Some local features do not require an account; AI analysis, account-bound entitlements, and certain cloud features require sign-in. You must provide accurate information, protect your credentials, and are responsible for activity under your account. The App may offer features without charge and may offer in-app purchases through the Apple App Store or Google Play. Availability, pricing, payment, billing, and refunds are governed by the applicable store listing and policies.
除适用法律或商店政策另有规定外,内购一经完成通常不可退款。请在购买前确认所购内容。Except as required by applicable law or store policy, IAP are generally non-refundable once completed. Please confirm your purchase before buying.
你通过本 App 录制、采样、导入或创作的音频与作品（“你的内容”）仍归你所有。普通导入和编辑主要在设备上进行；iCloud / Google Drive 同步与 AI 分析的数据流见隐私协议。你选择这些功能时，授予我们及 Cloudflare、RunPod、Apple 或 Google 等必要服务商一项有限、非独占、仅为提供所请求功能所需的许可，以复制、传输、临时或持续存储、转换和处理相应内容。该许可在相关内容仍为提供功能、处理安全/争议或履行法律义务所需期间有效。Audio and works you record, sample, import, or create through the App ("Your Content") remain yours. Ordinary import and editing happen mainly on-device; see the Privacy Policy for iCloud / Google Drive sync and AI-analysis data flows. When you choose those features, you grant us and necessary providers such as Cloudflare, RunPod, Apple, or Google a limited, non-exclusive license to copy, transmit, temporarily or persistently store, transform, and process the relevant content only as needed to deliver the requested feature. This license lasts while that content remains necessary for the feature, security or dispute handling, or legal obligations.
你需拥有上传、处理和使用你的内容所需的权利与许可。请勿提交你无权处理的受版权、隐私或其他权利保护的内容。You must have all rights and permissions needed to upload, process, and use Your Content. Do not submit content that you are not authorized to process under copyright, privacy, or other laws.
你同意不将本 App 用于任何非法目的,且不会:You agree not to use the App for any unlawful purpose, and not to:
本 App 及其音频引擎、界面设计、内置音色包、商标与标识等,均为我们或相应权利人所有,受相关法律保护。本条款未明确授予的权利均予保留。内置音色包仅授权你在本 App 内使用,你创作的作品可自由使用。The App and its audio engine, interface design, built-in tone packs, trademarks and logos are owned by us or the respective rights holders and are protected by law. All rights not expressly granted are reserved. Built-in tone packs are licensed for use within the App; works you create with them are yours to use freely.
本 App 依赖 Cloudflare（API、账号数据库、AI 文件存储与日志）、RunPod（AI 算力）、Google Firebase（分析与崩溃诊断）、Resend（账号邮件）以及你选择使用的 Apple / Google 登录、iCloud、Google Drive 和应用商店服务。第三方服务受其自身条款约束，可能中断、变更或在不同地区处理数据；详情见隐私协议。The App relies on Cloudflare (APIs, account database, AI file storage, and logs), RunPod (AI compute), Google Firebase (analytics and crash diagnostics), Resend (account email), and the Apple / Google sign-in, iCloud, Google Drive, and app-store services you choose. Third-party services are governed by their own terms, may be interrupted or changed, and may process data in different regions; see the Privacy Policy.
本 App 按“现状”和“现有”提供，不附带任何明示或默示保证。AI 分轨、BPM 与鼓谱草案可能不准确、不完整或失败，不构成专业教学或对演奏水平的评价；请在使用或演出前自行试听、检查和修改。我们不保证服务不会中断、没有错误，也不保证所有设备达到某个具体音频延迟。The App is provided "as is" and "as available" without express or implied warranties. AI stems, BPM, and drum-chart drafts may be inaccurate, incomplete, or fail; they are not professional instruction or an assessment of performance. Listen, review, and edit before relying on them or performing. We do not guarantee uninterrupted or error-free service or any specific audio-latency figure across devices.
在适用法律允许的最大范围内,我们不对任何间接的、附带的、特殊的或后果性的损害(包括数据丢失、利润损失)承担责任。在任何情况下,我们就本 App 产生的累计责任不超过你在过去十二个月内就本 App 向我们支付的金额(如有)。To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential damages (including loss of data or profits). In no event shall our aggregate liability arising from the App exceed the amount, if any, you paid us for the App in the preceding twelve months.
若你违反本条款，我们可暂停或终止账号或服务访问。你可卸载 App，并可在 App 内申请删除账号；删除账号不会自动删除本机项目、iCloud / Google Drive 副本、AI 文件或依法/合理需要保留的购买、安全与争议记录。具体删除范围见隐私协议。终止后，按其性质应继续有效的条款仍然有效。We may suspend or terminate an account or service access if you breach these Terms. You may uninstall the App and may request account deletion in the App. Account deletion does not automatically delete local projects, iCloud / Google Drive copies, AI files, or purchase, security, and dispute records retained as legally or reasonably necessary. See the Privacy Policy for deletion scope. Provisions that should survive by their nature remain effective.
本条款受中华人民共和国法律管辖并据其解释(不含冲突法规则)。因本条款引起的争议,应首先通过友好协商解决;协商不成的,提交我们所在地有管辖权的法院处理。本条款亦不影响你作为消费者在当地法律下享有的强制性权利。These Terms are governed by and construed under the laws of the People's Republic of China (excluding conflict-of-law rules). Disputes shall first be resolved through friendly negotiation; failing that, by a competent court at our place of business. These Terms do not affect mandatory consumer rights you may have under your local law.
我们可能不时修订本条款。重大变更会在 App 内或本页面公示并更新日期。变更生效后继续使用本 App,即表示你接受修订后的条款。We may revise these Terms from time to time. Material changes will be posted in the App or on this page with an updated date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
